LightTPD (on Cygwin) with commercial software under Windows?

Want to use build of LightTPD on Windows under Cygwin as a frontend to FastCGI module in a commercial product. Product together with all the build clients installed on your machine by the installer. The Assembly is used only binary LightTPD (which required pulling a Cygwin1.dll and other joy). The server code I do not touch, only my frontend, it is native and Cygwin does not use.


The author of this build LightTPD says that it is licensed under BSD. But, however, the Cygwin GPL license!


Can I use the build in commercial software (of course, respecting BSD)?

You can use licensed under the GPL FOR any purpose, including to put in your distribution. But you must provide the source code of this software on your site, or issue upon request. Because statically with GPL code nothing link, the license applies only to the cygwin DLL and, consequently, lighttpd.

In General, use safely, no you will not.
